These Terms and Conditions apply to the use of this website and to the purchase of products from Fenceway. By placing an order with us, you agree to be bound by them.

2. Products

We make every effort to ensure that product descriptions, specifications, dimensions, photographs and pricing are accurate. Many of our products are made from natural materials, including timber, hazel and willow. Variations in colour, size, texture and appearance may occur. These natural variations are not considered defects.

3. Pricing and payment

All prices shown are in Pounds Sterling and include VAT where applicable. Delivery is charged separately and is shown at checkout before you pay. We reserve the right to amend prices at any time without prior notice. The price payable is the price displayed at the time the order is placed. Payment must be received in full before goods are dispatched or delivered.

4. Orders

All orders are subject to acceptance and product availability. We reserve the right to refuse, cancel or limit any order at our discretion. If a product becomes unavailable after an order has been placed, we will contact you to arrange an alternative, a back-order or a refund.

5. Delivery

We aim to deliver within the estimated timescales provided. Delivery dates are estimates and are not guaranteed. For many local deliveries in the West Midlands we use our own vehicles and delivery team. Longer-distance orders are sent by pallet or parcel carrier.

You are responsible for making sure that accurate delivery information is provided, that there is suitable access for the delivery vehicle, and that someone is available to receive the goods where required. If delivery cannot be completed for reasons outside our control, additional delivery charges may apply. Risk in the goods passes to you on successful delivery.

6. Inspection of goods

Please inspect all goods as soon as possible after delivery. Any shortages, damage or defects must be reported within 48 hours of delivery, by email to contact@fenceway.co.uk. Photographic evidence may be requested. Reporting outside this period may affect our ability to resolve the issue.

7. Returns and cancellations

Consumers have rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You may cancel eligible orders within 14 days of receiving your goods, and have a further 14 days to return them. To qualify for a refund, goods must be unused, in their original condition and suitable for resale. You are responsible for return costs unless the goods are faulty or were supplied incorrectly. 8. Non-returnable items

• Custom or bespoke orders
• Special-order items obtained specifically for a customer
• Goods damaged after delivery through misuse, neglect or improper installation

9. Installation

Any installation information we provide is general guidance only. You are responsible for ensuring products are installed safely and correctly. We accept no liability for damage, injury or loss arising from incorrect installation or use.

10. Natural timber products

Natural timber may expand and contract with the weather, develop splits, cracks, knots or surface checking, and change colour over time through exposure to sunlight. These are natural characteristics of timber and are not manufacturing defects.

11. Limitation of liability

To the maximum extent permitted by law, our liability is limited to the value of the goods purchased. Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot legally be excluded.

12. Website use

All content on this website, including text, images, logos and product descriptions, remains our property unless otherwise stated, and may not be copied, reproduced or distributed without prior written permission.

13. Privacy

Personal information supplied to us is processed in accordance with our Privacy Policy and applicable UK data protection law.

14. Governing law

These Terms and Conditions are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
