1. About Us

These Terms & Conditions apply to the use of this website and the purchase of products from Fenceway.

Fenceway supplies fencing, garden, landscaping, and outdoor products to customers throughout the United Kingdom.

By placing an order with us, you agree to be bound by these Terms & Conditions.

2. Products

We make every effort to ensure that all product descriptions, specifications, dimensions, photographs, and pricing are accurate.

Many of our products are made from natural materials, including timber, hazel, and willow. As a result, variations in colour, size, texture, and appearance may occur. These natural variations are not considered defects.

3. Pricing & Payment

All prices shown on our website are in Pounds Sterling (£) and include VAT where applicable.

We reserve the right to amend prices at any time without prior notice. The price payable will be the price displayed at the time the order is placed.

Payment must be received in full before goods are dispatched or delivered.

4. Orders

All orders are subject to acceptance and product availability.

Fenceway reserves the right to refuse, cancel, or limit any order at our discretion.

If a product becomes unavailable after an order has been placed, we will contact you to arrange an alternative product, back-order, or refund.

5. Delivery

Fenceway aims to deliver orders within the estimated timescales provided. Delivery dates are estimates and are not guaranteed.

For many local deliveries within the West Midlands, Fenceway may use its own vehicles and delivery team to provide a reliable and personalised service.

Customers are responsible for ensuring:

• Accurate delivery information is provided.
• Suitable access is available for delivery vehicles.
• Someone is available to receive the goods where required.

If delivery cannot be completed due to circumstances beyond our control, additional delivery charges may apply.

Risk in the goods passes to the customer upon successful delivery.

6. Inspection of Goods

Customers should inspect all goods as soon as possible after delivery.

Any shortages, damages, or defects must be reported within 48 hours of delivery. Photographic evidence may be requested to assist with any claim.

Failure to notify us within this period may affect our ability to resolve the issue.

7. Returns & Cancellations

Consumers have rights under the Consumer Contracts Regulations 2013.

You may cancel eligible orders within 14 days of receiving your goods.

To qualify for a refund:

• Goods must be unused.
• Goods must be returned in their original condition.
• Goods must be suitable for resale.

Customers are responsible for return costs unless the goods are faulty or supplied incorrectly.

Refunds will be processed within 14 days of receiving the returned goods.

8. Non-Returnable Items

The following items may not be eligible for return:

• Made-to-measure products.
• Custom or bespoke orders.
• Special-order items obtained specifically for a customer.
• Goods damaged after delivery through misuse, neglect, or improper installation.

9. Installation

Any installation information provided by Fenceway is intended as general guidance only.

Customers are responsible for ensuring products are installed safely and correctly.

Fenceway accepts no liability for damage, injury, or loss arising from incorrect installation or use of products.

10. Natural Timber Products

Natural timber products may:

• Expand and contract due to weather conditions.
• Develop splits, cracks, knots, or surface checking.
• Change colour over time through exposure to sunlight and weather.

These characteristics are natural features of timber and are not considered manufacturing defects.

11. Limitation of Liability

To the maximum extent permitted by law, Fenceway's liability shall be limited to the value of the goods purchased.

Nothing in these Terms & Conditions excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded.

12. Website Use

All content on this website, including text, images, logos, and product descriptions, remains the property of Fenceway unless otherwise stated.

Content may not be copied, reproduced, or distributed without prior written permission.

13. Privacy

Personal information supplied to Fenceway will be processed in accordance with our Privacy Policy and applicable UK data protection laws.

14. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

Any disputes arising from these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
